Privacy Policy

This Privacy Policy applies to all Intentify products, including SmartRep and SmartDiscovery. Where data practices differ between products, those differences are called out explicitly.
1. Introduction
Danny Robles, LLC DBA Intentify (“Intentify,” “we,” “us,” or “our”) operates the SmartRep and SmartDiscovery platforms. This Privacy Policy explains how we collect, use, share, and protect information across all Intentify products and services.
This policy covers two primary contexts: (1) information Intentify collects directly from Customers who use our platform, and (2) information processed through Intentify on behalf of Customers when their End Users interact with Intentify-powered features.
If you are an End User interacting with an AI agent or tool embedded on a third-party website or application, the privacy practices of that Customer also apply to you. Please review their privacy policy in addition to this one.
2. Information We Collect
2.1 Account and Customer Information (All Products)

Name, email address, and business contact details provided at registration.

Billing information (processed by a PCI-compliant third-party payment processor; Intentify does not store full card numbers).

Account credentials and authentication data.

Usage data including features accessed, configurations created, and API activity.

Support communications and feedback submitted to Intentify.
2.2 SmartRep — End User Interaction Data

Chat messages and conversation transcripts between End Users and AI agents deployed by Customers.

Contact information (e.g., name, email address) if configured by the Customer to collect it.

Device and browser metadata (IP address, browser type, OS) collected for security and analytics purposes.

Any additional data fields configured by the Customer in their agent setup.
Customers control the scope of End User data collected through SmartRep. Intentify processes this data as a service provider on the Customer’s behalf. Customers are responsible for obtaining lawful bases for collection and for complying with applicable privacy laws.
2.3 SmartDiscovery — Business Analysis Data

Website URLs and publicly available website content submitted for analysis.

Business context inputs provided by the Customer (goals, services, target audience, problem statements).

AI-Generated Outputs produced during the discovery process, including personas, journey maps, and strategic recommendations.

Session interaction data (questions asked, directions selected, refinements made).
SmartDiscovery analyzes third-party website content and business inputs to generate strategic insights. Intentify does not represent that website content analyzed through SmartDiscovery is licensed to Intentify or Customer. Customers are responsible for ensuring their use of such analysis complies with applicable terms of service and laws.
2.4 Automatically Collected Platform Data

Log files and diagnostic data for platform stability and performance monitoring.

Cookies and similar technologies (see Section 5).

Aggregate and de-identified analytics data used to improve the platform.
3. How We Use Information
Intentify uses collected information to:

Provide, operate, and maintain the Services and all features thereof.

Process billing transactions and manage Customer accounts.
-
Route conversation and analysis data to AI providers to generate outputs.

Detect, prevent, and investigate fraud, abuse, and security incidents.

Respond to Customer support requests and communications.
-
Comply with legal obligations and enforce our MSA and AUP.

Analyze aggregate usage patterns to improve and develop the platform (using de-identified or aggregated data only).

Send transactional communications (billing confirmations, security alerts, product updates).
Intentify does not use End User conversation data or SmartDiscovery business inputs to train AI models made available to other customers without explicit Customer consent.
4. Sharing and Third Parties
Intentify shares data with third parties only as described below. Intentify does not sell personal data.

AI Providers: Customer Data and End User interaction data is transmitted to third-party AI providers solely to generate requested outputs. These providers operate under data processing agreements with Intentify.

Hosting and Infrastructure: Intentify uses cloud infrastructure providers to store and process data. Providers are selected for security and compliance standards.

Payment Processors: Billing information is handled by a PCI-compliant payment processor. Intentify does not store complete payment card data.

Analytics Providers: Intentify uses Google Analytics to understand platform usage patterns. Only de-identified or aggregated data is shared for this purpose.

Legal Requirements: Intentify may disclose data when required by applicable law, regulation, or valid legal process, or to protect the rights, safety, or property of Intentify, its customers, or the public.

Business Transfers: In the event of a merger, acquisition, or sale of assets, Customer data may transfer as part of the transaction. Intentify will notify affected Customers in advance where practicable.
5. Cookies and Tracking
Intentify uses cookies and similar technologies for the following purposes:

Essential Cookies: Required for authentication, session management, and core platform functionality. Cannot be disabled without affecting platform use.

Analytics Cookies: Help us understand how Customers use the platform. Used by Google Analytics.

Preference Cookies: Store Customer preferences such as language, display settings, and dashboard configurations.
Intentify does not use advertising cookies and does not share data with advertisers. Customers may manage cookie preferences through their browser settings, though disabling essential cookies may impact platform functionality.
6. Data Retention
Intentify retains data for the following periods, unless a longer retention period is required by law:

Customer account data: Retained for the duration of the account and for [24 months] following account closure.

SmartRep conversation transcripts: Retained for [90 days] by default. Customers may configure shorter retention or request deletion at any time.

SmartDiscovery session data and outputs: Retained for [90 days] by default. Customers may export or delete their discovery outputs at any time through the dashboard.

Billing records: Retained for [7 years] as required by applicable financial regulations.
-
Security and access logs: Retained for [12 months] for fraud prevention and incident response.
After the applicable retention period, data is securely deleted or anonymized. Customers may request earlier deletion subject to Intentify’s data deletion procedures.
7. Your Rights
Depending on your location, you may have the following rights regarding your personal data:

Access: Request a copy of personal data Intentify holds about you.

Correction: Request correction of inaccurate or incomplete data.

Deletion: Request deletion of your personal data, subject to legal retention obligations.
-
Portability: Request a machine-readable export of your data.
-
Objection / Restriction: Object to or request restriction of certain processing activities.

Non-Sale Confirmation: Intentify does not sell personal data. California residents may confirm this right under the CCPA.
To exercise any of these rights, contact support@intentify.co. Intentify will respond within 30 days, or as otherwise required by applicable law. End Users seeking to exercise rights over data collected through a Customer’s deployment should contact that Customer directly.
8. Children’s Privacy
Intentify’s Services are not directed to individuals under the age of 13 (or the applicable age of digital consent in the relevant jurisdiction). Intentify does not knowingly collect personal data from children. Customers are prohibited from using any Intentify product to knowingly collect data from children without obtaining verifiable parental or guardian consent and complying with all applicable laws, including COPPA.
If you believe a child has submitted personal data through an Intentify product, please contact us at support@intentify.co and we will promptly investigate and delete such data.
9. International Data Transfers
Intentify is operated from Arizona / Maricopa County. If you access the Services from outside this jurisdiction, your data may be transferred to and processed in jurisdictions with different data protection laws. Where required, Intentify relies on appropriate transfer mechanisms, including Standard Contractual Clauses, to ensure adequate protection of transferred data.
10. Security
Intentify implements reasonable technical and organizational safeguards, including:

Encryption in transit (TLS 1.2 or higher) and encryption at rest.

Role-based access controls limiting internal access to Customer and End User data.

Regular security assessments and vulnerability monitoring.

Incident response procedures for data security events.
No system is completely secure. In the event of a data breach that poses significant risk to affected individuals, Intentify will notify affected Customers without undue delay and as required by applicable law.
11. Changes to This Policy
Intentify may update this Privacy Policy periodically. We will notify Customers of material changes via email or in-platform notice at least 14 days before the changes take effect. Continued use of any Intentify Service after the effective date of the updated policy constitutes acceptance.
